Persons with disabilities possess certain rights as a protected class. Generally, these rights are granted under the Constitution in the forms of due process and equal protection. More specifically, persons with disabilities are protected by the Americans with Disabilities Act, the Civil Rights Act, and the Individuals with Disabilities Education Act. Violations of the rights of persons with disabilities occur every day in a wide variety of settings. Civil rights violations occurred in the workplace, in schools, and in public facilities. Violations can be wide-ranging in form, but the most common violations center around access and accommodations.

Examples of Disability Rights Violations

For example, if a public building does not have a wheelchair accessible ramp or entryway, the agency that owns or operates that building may be compelled to install access. The power to force the government to accommodate for disabilities may not be unlimited, but the government is required to make reasonable accommodations wherever those accommodations can be identified.
An example under the Individuals with Disabilities Education Act may be a case where a school district does not provide adequate special education services to students with learning or cognitive disabilities.

A final example might be an employer does not provide reasonable accommodation to an employee who becomes disabled during the course of employment. The employer is required to provide accommodations to allow the employee either to continue to perform the same job or to prefer another job with the employer. Examples of accommodation might include more accessible workspaces using alternative computer input devices, public devices, or software.

Enforcing civil rights and prosecuting violations thereof is important not only to persons with disabilities but to all of society. Violations affect everybody. If some of the most vulnerable citizens in our society can be trampled upon without repercussions, than the rights of everybody in our society are at risk.
